Swheeps Terms of Service

1. Acceptance of Terms

By accessing or using the Swheeps service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Swheeps provides a sweepstakes platform for the conduct of free-to-play sweepstakes games, as part of the Tasmanian Turf Club's Summer Swheeps promotion. Refer to the Summer Swheeps Terms and Conditions for full details.

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You must register and operate the account in accordance with the Summer Swheeps Terms and Conditions, including:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without authorization
• Impersonate any person or entity
• Collect or harvest personal information of other users

5. Content and Intellectual Property

Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

The Service and its original content, features, and functionality are owned by Swheeps and are protected by international copyright, trademark, and other intellectual property laws.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

8. Data Deletion and Account Removal

Summer Swheeps provides you with the right to request deletion of your account and personal data at any time.

How to Request Account Deletion

To delete your Summer Swheeps account and associated data, follow these steps:

1. Send an email to support@swheeps.com with the subject line "Account Deletion Request"
2. Include your account username and registered email address in your request
3. We will confirm receipt of your request within 48 hours
4. Your account and data will be permanently deleted within 30 days

What Data is Deleted

When you request account deletion, Summer Swheeps will permanently delete the following data:

• Email address: Permanently deleted from our active systems
• Password: Permanently deleted from our active systems
• Account profile: All associated account information will be removed

Data Retention Period

Please note the following regarding data retention:

• Your email and password will be deleted from active systems immediately upon processing
• Backup systems may retain copies for up to 90 days for disaster recovery purposes
• After 90 days, all copies of your data will be permanently removed from all systems
• We may retain anonymized usage data that cannot identify you personally
• Any data required by law to be retained will be kept only for the legally mandated period

Important: Account deletion is permanent and cannot be reversed. Once deleted, you will need to create a new account to use Summer Swheeps again.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted or error-free
• The Service will meet your specific requirements
• Any errors in the Service will be corrected
• The Service is free from viruses or harmful components

10. Limitation of Liability

To the maximum extent permitted by law, Swheeps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Swheeps and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law and Disputes

The Terms are governed by and construed in accordance with the laws in force in New South Wales, Australia.

Each party irrevocably and unconditionally submits to the jurisdiction of the courts of New South Wales, Australia in respect to any dispute or matter arising from these Terms and waive any right to object to any proceedings being brought in those courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
